Terms and Conditions for Services:
Client agrees to pay the photographer a non-refundable initial payment for the photography services stated upon signing a contract. Any remaining balance of the full invoiced amount for a photography services stated in the contract must be paid in full 14 days (2 weeks) to the start of the session. If client does not pay the remaining balance before the start of the session, photographer will still work on the date of session within the terms of the contract and quote. If client does not pay remaining balance before the session, client will not have any access to any images taken from the session until the remaining balance is paid in full, this includes any proofs or products. If payment is received, and for whatever reason the payment is canceled or returned, a $50 fee will be charge to the client for canceled or returned payment. This includes, but is not limited to, returned or bounced checks and canceled or withdrawn bank transactions. If client cancels the session for any reason at any time and has only paid the initial payment, the initial payment will not be returned to payee. Rescheduling due to weather is determined by the photographer. Rescheduling is allowed with no fee or penalties due to a major life event that are out of the clients control.
Client is responsible for paying any entrance and parking fees required to enter onto a property.
Clients are not allowed to have access or obtain RAW files of the images taken. Clients are only allowed access to processed or enhanced high resolution JPEG or JPG files only. The photographer, legal copyright holder of all Ultimate Edge Photography photographs, will grant permission to the client to make prints or enlargements of any of the photography from their own CD/DVD, flash drive or digitally downloaded images. The copyright of photographs remains with the photographer. Client can not alter any images provided to them in relation to the session in any way. If client wants any altercations done to an image(s), they must contact the photographer and pay an advanced edit fee so photographer may make adjustment to the image desired. If client alters a image in any way without photographer approval, the client is subject to a $500 fee payable to Ultimate Edge Photography for going against the terms of the contract.
If photographer is unable to perform the services in this contract due to any cause outside its control, client agrees to indemnify photographer for any loss, damage, or liability. Photographer and client agree that photographer is under no obligation to capture any specific moment or pose or person(s) during the shoot. If photographer is too ill or becomes injured and cannot supply the services specified in the contract the photographer will try to book a replacement photographer. If a second photographer is on staff for the day of event, and if the second photographer is available, then the second photographer will take over the event on his/her own. If both photographers are unavailable and a replacement photographer cannot be found then liability is limited to a refund of any and all payments received.
Ultimate Edge Photography has working methods in place to prevent loss or damage to your images. However, there is the unlikely possibility that images may be lost, stolen or destroyed for reasons in or beyond photographers control. In these circumstances, photographer will return all payments made by client to photographer in relation to this shoot in the event lost data is not salvageable. If photographer is able to salvage more than seventy-five percent of the images taken, photographer will not issue a refund for any payments made by client to photographer in relation to this shoot. Client agrees to indemnify and hold harmless photographer for any liability, damage, or loss related to technological failure, including data loss.
Photographer does maintain business insurance in the unlikely event of an injury that may happen to the client, guest, or staff member while posing or working with the photographer. Client agrees to hold photographer harmless for any personal injury which may occur as the client or any guest poses or works with photographer.
If for whatever reason the photographer feels threatened, disrespected, uncomfortable, or mistreated by the client or a guest involved in the session, the photographer has the right to terminate this contract and service in full. If photographer terminates this contract and service for any reason, the photographer must return all payments made by the payee, including the initial payment. Any services previously provide by photographer for the client will not be billed to the client and service previously provided will be considered an out-of-pocket expense to the photographer due to the client and photographer not being a good fit for each other. The client gives permission to the photographer and/or company to terminate at any time before or during a session, if the photographer feels any hostile actions or emotions from the client or guest involved. Termination of this contract and service by the photographer or company will results in the clients accepting responsibility that the client must find another photography service or company on their own.
All products delivered to client are non-returnable and non-refundable. If there is a manufacturing error, photographer will replace the product at no additional charge.
